My Floor Haven is committed to complying with all applicable sales and use tax regulations. This policy outlines how we collect and remit sales tax for transactions made through our online store.

Sales Tax Collection

1. Sales Tax Nexus in New Mexico

My Floor Haven is headquartered in New Mexico and has a physical and economic nexus in the state. As a result, we are required to collect and remit sales tax on all orders shipped to addresses within New Mexico.

2. Sales Tax on Orders Shipped to New Mexico

Orders delivered to addresses within New Mexico are subject to state and local sales tax, which varies based on the destination address. The applicable sales tax rate will be calculated at checkout and included in the total order amount.

Why Does Sales Tax Vary in New Mexico?

New Mexico applies a gross receipts tax (GRT), which is a combination of state, county, and municipal tax rates. Unlike traditional sales tax, GRT is imposed on businesses but is typically passed on to consumers at the point of sale. The total tax rate depends on:

  • Statewide Base Rate: The statewide gross receipts tax rate is 5.125%.

  • Local Jurisdictions Add Additional Tax: Counties and municipalities can impose their own tax rates, leading to location-based variability.

  • Destination-Based Taxation: The applicable tax rate is based on the delivery address, not just where the business is located.

Examples of Gross Receipts Tax Rates in New Mexico:
  • Albuquerque (Bernalillo County): 7.875%

  • Santa Fe (Santa Fe County): 8.1875%

  • Las Cruces (Dona Ana County): 8.3125%

  • Rio Rancho (Sandoval County): 7.6875%

  • Roswell (Chaves County): 7.8333%

For example, if a business in Albuquerque sells a product and ships it to Santa Fe, the applicable tax rate is 8.1875%, not Albuquerque’s 7.875% rate.

3. Out-of-State Orders

For customers outside New Mexico, My Floor Haven does not collect sales tax unless required by law. If your state has a use tax requirement, you may be responsible for reporting and remitting use tax directly to your state’s tax authority.

Exemptions and Resale Certificates

1. Tax-Exempt Purchases

If you qualify for a tax exemption (e.g., resale, government agency, or nonprofit organization), you must provide a valid exemption certificate before placing an order. To apply for tax-exempt status, please email your exemption certificate to support@myfloorhaven.com for approval.

2. Resale Certificates

Businesses purchasing products for resale must provide a valid resale certificate issued by the New Mexico Taxation and Revenue Department or an equivalent agency in their state. Once verified, qualifying purchases will be exempt from sales tax.

Use Tax Responsibility

Customers purchasing from My Floor Haven and having products shipped outside of New Mexico may still have a use tax obligation in their respective states. We encourage you to consult your local tax authorities for compliance requirements.

Changes to Sales Tax Policy

My Floor Haven reserves the right to update this Sales and Use Tax Policy as tax laws and regulations evolve. Any changes will be reflected on our website.
